  • Dish Network Loses $300 million judgment

    Analyst believes DISH Network may lose ability to offer DVR.

    Reports from Multichannel News, Reuters.com and Yahoo.com have confirmed that TiVo Inc. prevailed once again in a long-running dispute with DISH Network over DVR patents.

    The U.S. Court of Appeals for the Federal Circuit upheld a lower court's contempt ruling against DISH Network and EchoStar. If the court decision stands, TiVo would collect at least $300 million from DISH Network -- about $100 million in damages and interest, and the rest in contempt sanctions that TiVo already has been awarded. That would be on top of about $100 million in damages that DISH Network had already paid TiVo.

    According to Sanford Bernstein analyst Craig Moffett, DISH Network may be forced to disable as many as 8 million of its DVRs within a month, after the satellite TV operator lost an appeals court decision Thursday in its years-long battle with TiVo. Moreover, DISH Network could even lose the ability to offer a DVR altogether. Moffett wrote in a research note. “What is at stake is nothing less than their ability to continue to offer DVRs. And without DVRs...well, you can fill in the blank here, but it wouldn't be pretty.”
